Purpose

Integrated Clinical Oncology Network Pty Ltd (ACN 151 293 891) (Icon) is an Australian company and is made up of numerous legal entities nationally and internationally (together, the Icon Group). The Slade entities (Slade, we, us and our) are set out at the end of this Privacy Policy and are part of the Icon Group.

Each member of Slade complies with all applicable laws governing how we process your Personal Information, including:

  • the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth);
  • any state specific requirements in Australia;
  • the Information Privacy Principles (IPPs) under the Privacy Act 2020 (New Zealand); and
  • the Health Information Privacy Code 2020 (New Zealand),
    (collectively, the Privacy Laws)

The principles set out in this policy apply to Personal Information you provide to us including information provided at consultations, treatments, via our web site or under any agreement or arrangement.

All Slade Pharmacies are independently owned and operated and follow their own policies and procedures that deal with their collection, use and disclosure of your personal information. In providing products and services to you, we may collect, hold, use and disclose your personal information from and to Slade Pharmacies as detailed in this Privacy Policy.

Scope

This Privacy Policy sets out and explains how Slade collect, use, store, protect and disclose your Personal Information. The Privacy Policy is supplementary to any specific consent you provide. For example, we will normally request your prior written consent for the collection, use or disclosure of your Health and/or Sensitive Information.

Definitions

Key terms used in this policy are consistent with the definitions in the relevant Privacy Laws, as follows:

(iii) a health service provided, or to be provided, to an individual;
that is also personal information;
(b) any personal information collected to provide, or in providing, a health service to an individual
(c) other personal information collected in connection with the donation, or intended donation, by an individual of his or her body parts, organs or body substances;
(d) genetic information about an individual in a form that is, or could be, predictive of the health of the individual or a genetic relative of the individual.
Sensitive Information means:
(a) information or an opinion about an individual’s: racial or ethnic origin; political opinions; membership of a political association; religious beliefs or affiliations; philosophical beliefs; membership of a professional or trade association; membership of a trade union; sexual orientation or practices; criminal record;
that is also personal information; or
(b) Health Information about an individual; or
(c) genetic information about an individual that is not otherwise health information; or
(d) biometric information that is to be used for the purpose of automated biometric verification or biometric identification; or
(e) biometric templates

Collection of Personal Information

The information we collect

The types of personal information that we collect about you may include:

  • Identity Data including your name, Medicare (if you are an Australian resident) or National Health Index (if you are a New Zealand resident) reference numbers, Concession Card reference numbers, Department of Veterans Affairs details and private health fund membership details including level of cover.
  • Contact Data including your phone number, address and email.
  • Financial Data including bank account and payment card details.
  • Transaction Data including details about payments to you from us and from you to us and other details of products and services you have purchased from us or we have purchased from you.
  • Technical and Usage Data when you access any of our websites, platforms or emails, details about your internet protocol (IP) address, login data, browser session and geo-location data, statistics on page views and sessions, device and network information, acquisition sources, search queries and/or browsing behaviour, access and use of our website (including through the use of Internet cookies or tracking pixels), and communications with our website.
  • Interaction Data including information you provide to us when you participate in any interactive features, including surveys, contests, promotions, activities or events.
  • Marketing and Communications Data including your preferences in receiving marketing from us and our third parties and your communication preferences.
  • Professional Data including where you are a worker of ours or applying for a role with us, your professional history such as your previous positions and professional experience, or whether you hold required authorisations or licences.
  • Sensitive Information including:
    • where you are a user of our services, information about you or your Dependents, including:
      • Health Information, including individual or family medical history;
      • racial or ethnic origin (so that we can provide culturally appropriate care where possible); and
      • details of any other support plan or treatment report provided to us;
    • where you apply for a role with us:
      • results of criminal records checks; and
      • your professional registrations and associations (where applicable).

How we collect information

We collect Personal Information in a variety of ways, including:

  • directly from you, including face to face, over the phone, over email, or online;
  • when you complete a form, such as registering for any events or newsletters or responding to surveys;
  • when you use any website we operate (including from any analytics and cookie providers or marketing providers. See the “Cookies” section below for more detail on the use of cookies);
  • from third parties, such as doctors, pharmacists or hospital providers, and any third party authorised by you.

In some cases, we will require you to specifically consent to any collection, use or disclosure of your Personal or Health Information as part of a treatment consent, financial consent, or other specific consent.

In most cases your consent will be requested in writing, but we may also accept your verbal consent. Sometimes your consent may also be implied through your conduct with us, or due to anticipated activities/reasons ancillary to the primary purpose of your prior consent.

We will destroy unsolicited information where it is determined that the information would not normally have been collected.

In cases of emergency where collection and disclosure of your Personal Information is necessary to prevent or lessen a serious and imminent threat to your life or health or where it is deemed that you lack physical or mental capacity, then we may collect and/or disclose such information from and/or to third parties without your consent if allowed by law, where applicable.

Sensitive information: We only collect, hold, use and disclose sensitive information for the following purposes:
• any purposes you consent to;
• the primary purpose for which it is collected;
• secondary purposes that are directly related to the primary purpose for which it was collected, including disclosure to the below listed third parties as reasonably necessary to work with you as a customer or supplier of our business;
• to contact emergency services, or to speak with your family, partner or support person where we reasonably believe there is a serious risk to the life, health or safety of you or another person and it is impracticable for us to obtain your consent; and
• if otherwise required or authorised by law.

Examples of uses and disclosures of your Personal Information include:

a) Health professionals involved in your care
Your information may be shared among treating health professionals (including Slade Pharmacies) to coordinate and deliver care, while maintaining confidentiality.

b) Referring doctors and GPs
We may send updates (e.g. discharge summaries) to your referring specialist or nominated GP to support ongoing treatment.

c) Other health service providers
With your consent—or without it if necessary to prevent serious harm—we may share your records with other providers or facilities involved in your care.

d) Students on clinical placement
Students in medical, nursing, pharmacy, or allied health may access records under supervision.

e) Family, guardians, or legal representatives
If you’re unable to consent, we may share information with close relatives or legal representatives when necessary for care or compassionate reasons.

f) Other Icon or Slade facilities
We may share information amongst our Slade Pharmacies and Slade facilities, including the Icon Group. This may occur to ensure the patient’s ongoing care is properly facilitated.

g) Other common uses and disclosures
We may also use or disclose your information:

  • For billing, Medicare, National Health Index, or Veterans’ Affairs NZ claims
  • To comply with any applicable laws, responding to a subpoena or compulsory reporting to regulatory authorities (e.g. law enforcement or public health and safety circumstances)
  • To medical defence organisations or legal advisers
  • To protect children or prevent serious threats to life or safety
  • To third-party service providers (bound by privacy laws)
  • For quality assurance and service improvement
  • To send appointment or treatment reminders
  • For approved research purposes

If you request or authorise us to transfer your Personal Information, including your health information, to another health service provider, we will provide a copy or a written summary of such to that other health service provider as soon as practicable.

Disclosure of Information to Third Parties

Personal Information

We will only disclose personal information (excluding sensitive information) to third parties where it is necessary as part of our business, where we have your consent, or where permitted by law. This means that we may disclose personal information (excluding sensitive information) to:

  • our employees, contractors and/or related entities;
  • third party pharmacies and entities;
  • IT service providers, data storage, web-hosting and server providers;
  • marketing or advertising providers;
  • delivery or logistics providers who deliver our goods to you;
  • professional advisors, bankers, auditors, our insurers and insurance brokers;
  • payment systems operators or processors;
  • our existing or potential agents or business partners;
  • sponsors or promoters of any promotions or competition we run;
  • if we merge with, or are acquired by, another company, or sell all or a portion of our assets, your personal information may be disclosed to our advisers and any prospective purchaser’s advisers and may be among the assets transferred;
  • courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services we have provided to you;
  • courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
  • third parties to collect and process data, such as analytics providers and cookies; and
  • any other third parties authorised by you, such as your family members and other providers; and
  • any other third parties as required or permitted by law, such as where we receive a subpoena.

Sensitive Information

We will only disclose Sensitive Information with your consent or where permitted by law. This means that we may disclose sensitive information to:

  • our employees, contractors and/or related entities;
  • third party pharmacies and franchisors;
  • if applicable to you, the NDIA, your support coordinator (if it is not us), your plan manager (if it is not us) and other health care professionals or persons/entities as necessary to provide our services;
  • IT service providers, data storage, web-hosting and server providers;
  • professional advisors;
  • if we merge with, or are acquired by, another company, or sell all or a portion of our assets, your personal information may be disclosed to our advisers and any prospective purchaser’s advisers and may be among the assets transferred;
  • courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
  • third parties to collect and process data, such as analytics providers and cookies;

Overseas Disclosure

Australian Residents

We store your Personal Information in Australia. Where we disclose your Personal Information to third parties, those third parties may store, transfer or access Personal Information outside of Australia. We will only disclose your Personal Information overseas in accordance with the Australian Privacy Principles.

New Zealand Residents

Where we disclose your Personal Information to third parties, those third parties may store, transfer or access Personal Information outside of New Zealand, which may not have an equivalent level of data protection laws as those in New Zealand. Before disclosing any Personal Information to an overseas recipient, we will comply with Information Privacy Principle 12 and only disclose the information if:

  • you have authorised the disclosure after we expressly informed you that the overseas recipient may not be required to protect the Personal Information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020;
  • we believe the overseas recipient is subject to the Privacy Act 2020;
  • we believe that the overseas recipient is subject to privacy laws that, overall, provide comparable safeguards to those in the Privacy Act 2020;
  • we believe that the overseas recipient is a participant in a prescribed binding scheme;
  • we believe that the overseas recipient is subject to privacy laws in a prescribed country; or
  • we otherwise believe that the overseas recipient is required to protect your Personal Information in a way that, overall, provides comparable safeguards to those in the Privacy Act 2020 (for example pursuant to a data transfer agreement entered into between us and the overseas recipient).

Access and Correction of Personal Information

In order to assist us in keeping your Personal Information accurate, complete and up to date, you are requested to promptly notify us of changes or updates to your Personal Information. You may request access to Personal Information we hold about you by making a written request to our Privacy Officer, whose details are below. We will respond to your requests within a reasonable period. Please note, in some situations, we may be legally permitted to withhold access to your Personal Information. If we cannot provide access to your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal. If we can provide access to your information in another form that still meets your needs, then we will take reasonable steps to give you such access.

If upon receiving access to your Personal Information, or at any other time, you believe the Personal Information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We take reasonable steps to correct your Personal Information so that it is accurate, complete and up to date. Please note, in some situations, we may be legally permitted to not correct your Personal Information. If we cannot correct your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal.

Security of Personal Information

We may store your Personal Information in both paper and electronic forms. The security of your Personal Information is important to us. We take reasonable measures to ensure that your Personal Information is stored safely to protect it from misuse, loss, unauthorised access, modification, interference, or disclosure, and take electronic and physical security measures such as:

  • locked storage of paper records;
  • use of document shredding and security bins;
  • authentication and password controls for electronic records; and
  • use of our managed devices and services (e.g. iPads, laptops, email) for transfer of Personal Information.

We will destroy or permanently de-identify any of your information which is in its possession or control and which is no longer needed for the purpose for which it was collected, unless otherwise required by law to be retained.

Periodic audit and risk assessments are conducted to ensure the appropriate availability, integrity and confidentiality of Personal Information managed through our systems.

In the event of a data breach, we will take immediate action to mitigate the breach and will comply with the mandatory data breach requirements of the Privacy Laws. We will assess whether there is a likely risk of any serious harm to affected individuals and if so, will immediately notify such individuals as reasonably practicable with a description of the data breach, the kinds of information concerned and recommendations about the steps that you should take in response to the data breach.

While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.

Cookies and Analytics

We may use cookies, tracking pixels and similar technologies on our website and in our emails from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Tracking pixels are tiny, invisible images (typically the size of one pixel) embedded in web pages or emails. Cookies and tracking pixels, by themselves, do not tell us your email address or other personally identifiable information. However, they do recognise you when you return to our online website and allow third parties to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our online website with Personal Information, this information may be linked to the data stored in the cookie or collected by tracking pixels. Unlike cookies, tracking pixels do not store any information on your device, but instead send information to our servers when the pixel is loaded.

Facebook/Meta Analytics

We may use tools provided by Meta, such as the Meta Pixel, advanced matching, and Conversions API. These allow us to measure ad performance and deliver ads that may be relevant to you on Meta platforms based on your activity on our website/app. You can control whether we can join data from third party partners with your Meta account for ads by adjusting your preferences within Meta’s settings. You can disconnect this data from your Meta account by changing your settings for Off-Facebook activity.
