SladePLUS Terms & Conditions

Slade Marketing Pty Ltd as trustee for the Slade Marketing Unit Trust ACN 600887205 of 14 Palmer Court, Mount Waverley, Victoria 3149 (Slade Marketing) operates the SladePLUS loyalty program (Program) in participating Slade pharmacies (each a SladePLUS Pharmacy) in accordance with these terms and conditions (Conditions). Not every Slade pharmacy is a SladePLUS Pharmacy. The identity and location of the SladePLUS pharmacies are subject to change without notice.

Membership Eligibility

Only individual persons who reside in Australia are eligible to be a member of the Program. Your Membership Account cannot be used in connection with a business and must only be used by you (as the registered cardholder) or your authorised secondary cardholders (but you remain liable for any acts or omissions of those persons in connection with such use). Limit one Membership Account per person.

Membership Applications

To apply to join the Program, you must complete the Program application form available at a SladePLUS pharmacy or online. Applicants are required to provide to Slade Marketing, at a minimum, their name, address, gender, date of birth, mobile phone number and email address (Information). After you complete the Program application form (including the Information) and meet the Eligibility Criteria, if Slade Marketing accepts your application, your Membership Account will be activated and ready for use. Slade Marketing (or the SladePLUS Pharmacy as its agent) reserves the right to accept or reject your application, and to categorise you as a ‘VIP’ member (VIP) in its sole discretion.

Using SladePLUS

You can use your Membership Account by providing your membership identifier (e.g. phone number) at the register when purchasing Eligible Items at SladePLUS Pharmacies. Eligible Items are any goods (excluding gift vouchers and lay-buy purchases) for sale in a Slade Pharmacy. Eligible products are not:

(a) PBS prescription items;

(b) Non-PBS prescriptions items under $41.30 or over $2000 in one transaction

(c) baby formula;

(d) any other items, offers or promotions that Slade Marketing or a SladePLUS Pharmacy determines or advertises (from time to time) as being excluded from the Program; and (d) any items where the accrual of SladePLUS Cash (as defined in clause 4 below) on those items would be prohibited by law.

Each SladePLUS Pharmacy reserves the right to require valid identification linked to your Membership Account if presented at the in-store register after the transaction has commenced. You must notify Slade Marketing if your Information changes on 03 8420 0700 or by email [email protected].

Earning SladePLUS Cash

For purchases of at least $1 in a single transaction of Eligible Items in a SladePLUS Pharmacy, you will earn credit called ‘SladePLUS Cash’ (SladePLUS Cash) at a rate of 5 cents of SladePLUS Cash for every $1 paid for such Eligible Items (“Rate”). The accrued SladePLUS Cash will be added to the balance of SladePLUS Cash on your Membership Account within approximately one hour. Slade Marketing may also determine (in its sole discretion) that a different or bonus Rate of SladePLUS Cash is earned by VIPs or in relation to bonus offers or special promotions from time to time, including but not limited to in relation to specified Eligible Items or transactions at SladePLUS Pharmacies. Any SladePLUS Cash issued, earned or accrued as a result of fraud, dishonestly or error or that relates to a transaction that is cancelled or refunded (for any reason) will be cancelled by Slade Marketing and debited from the balance of SladePLUS Cash on your Membership Account. You can check your SladePLUS Cash balance of your Membership Account at a SladePLUS Pharmacy.

Redemption of SladePLUS Cash

You can redeem SladePLUS Cash by using it in part or full payment for Eligible Items in SladePLUS pharmacies. SladePLUS Cash can only be used by the person on whose Membership Account accrued the balance. SladePLUS Cash cannot be used to purchase products on lay-by. The redemption of SladePLUS Cash in conjunction with other promotions and offers is at the sole discretion of Slade Marketing. SladePLUS Cash and any benefit conferred on you in connection with the Program is not property or cash, does not have any cash or monetary value, cannot be redeemed for cash, and cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Conditions. To avoid doubt, you will not receive a cash refund if the SladePLUS Cash balance on your Membership Account exceeds the price of the items purchased using SladePLUS Cash and you cannot exchange SladePLUS Cash for cash or currency. SladePLUS Cash after SladePLUS Cash was earned or accrued, unless otherwise determined by Slade Marketing in writing.

Other Benefits

Third parties may offer you benefits in connection with your Membership Account. Additional conditions will apply to promotions run by third parties.

General

7.1 Slade Marketing may at any time (in its sole discretion and without prior notice to you):

(a) vary these Conditions, including but not limited to varying the Rate and the value, length or validity of the SladePLUS Cash;

(b) suspend, terminate or cancel the Program or its agreement with you or your membership of the Program, in whole or in part; and / or

(c) suspend or cancel your Membership Account or any or all of the SladePLUS Cash issued to or accrued by you.

If your membership of the Program is terminated, you will not be eligible to accrue or redeem SladePLUS Cash. If your membership of the Program is suspended, you will not be eligible to accrue or redeem SladePLUS Cash for the duration of the suspension.

7.2 Without limiting clause 7.1, Slade Marketing may (from time to time in its sole discretion without notice) vary these Conditions, and it will endeavour (but is not obliged) to notify significant variations to you by email, SMS or post (in accordance with the Information provided by you to Slade Marketing) or by notice displayed in a SladePLUS Pharmacy.

7.3 You can terminate your Membership Account at any time by notifying Slade Marketing in writing to [email protected]. All SladePLUS Cash accumulated by you as at the termination date will automatically be forfeited.

7.4 You acknowledge and agree that:

(a) a Slade pharmacy does not have any authority to make any representation, warranty or statement on behalf of Slade Marketing in relation to the Program, except where otherwise stated in these Conditions; and

(b) any goods supplied on redemption of SladePLUS Cash are supplied by the relevant SladePLUS pharmacy and not by Slade Marketing. Slade Marketing and each Slade pharmacy are not liable for each other’s acts or omissions.

7.5 To the extent permitted by law and subject to clause 7.4, Slade Marketing and all Slade pharmacies exclude all liability for loss and damage (including direct, indirect, special or consequential loss and loss of opportunity) howsoever arising in connection with:

(a) the exercise of their respective rights and discretions under these Conditions, including but not limited to the rights referred to in clauses 7.1 and 7.2;

(b) the operation, suspension or termination of the Program or your membership of the Program (including the accrual and redemption of SladePLUS Cash, and any delays, errors or omissions in recording the accrual and redemption of SladePLUS Cash).

7.6 Nothing in these Conditions is intended or will be construed as excluding, restricting or modifying or having the effect of excluding, restricting or modifying the application of all or any of the provisions of Div 1 of Part 3-2 of the Australian Consumer Law. Slade Marketing’s liability in respect of any Consumer Guarantees which cannot be excluded under the Australian Consumer Law is limited to credit against purchases of Eligible Items equivalent to your SladePLUS Cash balance.

7.7 Any tax, liability or duty incurred by you in connection with the Program is your responsibility.

Privacy

Slade Marketing is bound by the Privacy Act 1988 (Cth) (Privacy Act) and must comply with the Australian Privacy Principles (APPs). Slade Marketing has developed a Privacy Policy and Collection Notice as a simple way of informing you about the way that it handles the personal information collected about you (the matters set out in A PP5).
