Slade Pharmacy Management Pty Ltd ACN 606 897 750 of 11-13 Palmer Court, Mount Waverley, Victoria 3149 (“Slade Marketing”) operates the SladePLUS loyalty program (“Program”) in participating Slade Pharmacy locations (“SladePLUS Pharmacies”) in accordance with these terms and conditions (“Terms”). In these Terms, you means the person participating in the Program.
Not all Slade Pharmacy locations participate in the Program. SladePLUS Pharmacies may change and Slade Marketing will provide notice in accordance with clause 7 (Program Management).
Membership Eligibility
- Membership is open to individuals residing in Australia
- Membership is for personal, non-commercial use only
- Limit of one SladePLUS membership per person
- To join, members must:
- Be aged 18 years or over
- Provide their first name, valid mobile phone number, and email address
- Slade Marketing reserves the right to accept or reject any membership application
Joining the Program
- You can join SladePLUS in-store or online by providing the required personal details (“Information”)
- Your mobile number will be used to identify your membership (no physical card is issued)
- Membership is activated immediately upon acceptance by Slade Marketing. SladePLUS Cash earning commences with your first Qualifying Purchase.
- Use of the Program constitutes agreement to these Terms
Using your SladePLUS membership
- Provide your mobile number at checkout to earn or redeem rewards
- No physical membership card is required
- Notify Slade Marketing of changes to your details via email to [email protected]
- Slade Marketing may request identification to verify membership
Earning SladePLUS Cash
- When you make Qualifying Purchases, you may accrue SladePLUS Cash which will be earned at a ratio of 1 SladePLUS Cash for $20 spent i.e. 5% back in SladePLUS Cash on in-store Eligible Item purchases (“Rate”)
- SladePLUS Cash is added to your account within one hour of the Qualifying Purchase transaction to your account
- Slade Marketing may apply bonus offers or special earn rates from time to time
Exclusions:
SladePLUS Cash can only be earned for Eligible Items. For clarity, SladePLUS Cash is not earned on:
- Prescription items
- Baby formula
- Gift cards or lay-by purchases
- Any products or offers that Slade Pharmacy or Slade Marketing exclude
- Any items where rewards are restricted by law
Redeeming SladePLUS Cash
- SladePLUS Cash can be used in full or part payment for Eligible Items
- Redemption must occur in a participating Slade Pharmacy location
- Only the account holder can redeem their balance
- SladePLUS Cash:
- Cannot be exchanged for cash
- Has no cash value
- Cannot be transferred or sold
- Cannot be used for account payment
- Expires 24 months after being earned unless otherwise advised.
- No refunds are issued for unused or excess SladePLUS Cash
Vouchers and Offers
- A $10 SladePLUS Cash welcome voucher will be issued within 48 hours of new member sign-up
- A $10 SladePLUS Cash birthday voucher will be sent during your birthday month (if birth date is captured on your profile)
- Vouchers are valid for 30 days from date of issue
- From time to time, Slade Marketing may contact members with exclusive offers via email, direct mail, SMS or in-store vouchers.
- All offers and vouchers are subject to availability and may vary by (a) participating SladePLUS Pharmacies locations; (b) stock availability at time of redemption and (c) seasonal or time-limited campaigns.
- Each offer or voucher may be subjects to its own specific terms and conditions, which will be clearly displayed and available at the participating SladePLUS Pharmacies locations and accessible via Slade Marketing’s website.
- Subject to your Consumer Law Rights, redemption of any offer or voucher is limited to the account holder only. Slade Marketing reserves the right to verify the account holder’s identity before accepting the redemption.
Program Management
- Slade Marketing may amend these Terms, vary the Program and/or the Rate from time to time, where reasonably necessary for its business operations, legal compliance or to improve the Program. Slade Marketing will provide you with at least 30 days’ written notice to you. By clicking, “I accept” or continuing to use the Program after the notice or 30 days after notification (whichever date is earlier), you agree to the amended Terms, Program or Rate. If you do not agree to the amendment, you may stop participating in the Program.
- If your membership is suspended or terminated in accordance with clause 11 (Termination):
- You cannot earn or redeem SladePLUS Cash
- Any existing rewards may be forfeited
- You can cancel your membership at any time by contacting [email protected]
Australian Consumer Law
- In some jurisdictions, you may have guarantees, rights or other remedies provided by law (Consumer Law Rights), and these Terms do not restrict your Consumer Law Rights. Slade Marketing will only be bound by your Consumer Law Rights and the express wording of these Terms.
- Subject to your Consumer Law Rights, Slade Marketing do not provide a refund for a change of mind or change in circumstance.
- If you accept these Terms in Australia, nothing in these Terms should be interpreted to exclude, restrict or modify the application of, or any rights or remedies you may have under, any part of the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
Liability
- Despite anything to the contrary but subject to your Consumer Law Rights, to the maximum extent permitted by Law
- neither party will be liable for Consequential Loss;
- a party’s liability for any Liability under these Terms will be reduced proportionately to the extent the relevant Liability was caused or contributed to by the acts or omissions of the other party, including any failure by that other party to mitigate its loss; and
- Slade Marketing’s aggregate liability for any Liability arising from or in connection with these Terms will be limited to the replacement value in SladePLUS Cash you have accrued at the time of the relevant incident
Termination
- If you want to stop participating in the Program, you can let us know, including by email at [email protected].
- We may at any time terminate these Terms, including where we decide to discontinue the Program. We will give you an opportunity by giving you at least 90 days’ written notice to redeem any existing SladePLUS Cash.
- Upon termination of these Terms, Slade Marketing will retain Your Data (including copies) as required by law or regulatory requirements.
- Any other rights or liabilities that Slade Marketing or you may have will continue even after the Terms end.
Privacy & communications
- By joining the Program, you consent to receiving communications including promotional emails, text messages, updates on your account balance and any information related to the Program
- You may opt out of these communications at any time by contacting the relevant SladePLUS Pharmacy, sending an email to [email protected] or unsubscribing via the opt out facilities provided in the communications.
- Slade Marketing collect, hold and disclose and use any Personal Information you provide in accordance with its Privacy Policy available on our website, and applicable privacy laws.
- You must only disclose Personal Information to Slade Marketing if you have the right to do so (such as having the individual’s express consent).
- Slade Marketing may need to disclose Personal Information to third parties, such as its related companies or service providers (for example, IT and administrative service providers and professional advisors).
- Where Slade Marketing is required by law to report on its activities, you acknowledge that from time to time that Slade Marketing may request certain information from you in order to meet its requirements, and you agree to provide Slade Marketing with such information within the timeframes reasonably requested by Alade Marketing.
General
- Disputes: A party may not commence court proceedings relating to any dispute arising from, or in connection with, these Terms (Dispute) without first meeting a representative of the other party within 10 Business Days of notifying that other party of the Dispute. If the parties cannot resolve the Dispute at that meeting, either Party may refer the Dispute to mediation administered by the Australian Disputes Centre.
- Force Majeure: Neither party will be liable for any delay or failure to perform their respective obligations under these Terms if such delay or failure is caused or contributed to by a Force Majeure Event, provided that the party seeking to rely on the benefit of this clause:
(a) as soon as reasonably practical, notifies the other party in writing details of the Force Majeure Event, and the extent to which it is unable to perform its obligations; and
(b) uses reasonable endeavours to minimise the duration and adverse consequences of the Force Majeure Event.
Where the Force Majeure Event prevents a party from performing a material obligation under these Terms for a period in excess of 60 days, then the other party may by notice terminate these Terms, which will be effective immediately, unless otherwise stated in the notice. This clause will not apply to a party’s obligation to pay any amount that is due and payable to the other party under these Terms.
- Governing Law: This Agreement is governed by the laws of Queensland. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in Queensland and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in these courts.
Definitions
- Consequential Loss includes any consequential loss, special or indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
- Eligible Items are any goods (excluding gift vouchers and lay-buy purchases) for sale in a SladePLUS Pharmacy. Eligible products are not:
- Prescription items;
- baby formula;
- any other items, offers or promotions that Slade Marketing or a SladePLUS Pharmacy determines or advertises (from time to time) as being excluded from the Program; and
- any items where the accrual of SladePLUS Cash on those items would be prohibited by law.
- Force Majeure Event means any event or circumstance which is beyond a party’s reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.
- Liability means any expense, cost, liability, loss, damage, claim, notice, entitlement, investigation, demand, proceeding or judgment (whether under statute, contract, equity, tort (including negligence), indemnity or otherwise), howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent and whether involving a third party or a party to these Terms or otherwise.
- Personal Information means any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a tangible form or not.
- Qualifying Purchase means any purchase of Eligible Items with a minimum value of $1.00.
- Your Data means the information, materials and other intellectual property or data supplied by you when using the Program or stored by or generated by your use of the Program including any Personal Information collected, used, disclosed, stored or otherwise handled in connection with the Program.
